§ 61.49 Retesting after failure.
1. Applicant must receive additional ground and/or flight training from an authorized CFI. If Applicant was determined to be unsatisfactorily inflight, then sufficient training (either ground and/or flight) must be conducted to satisfy the additional training requirements. The decision for the type of additional training to be conducted is a decision to be determined by the Recommending CFI and Applicant. It usually makes common sense that additional flight training occur if the Applicant was determined Unsat during the Flight Test Portion. Although, in some situations, Ground Training or the use of a flight simulator (AATD) may only be necessary to sufficiently retrain the Applicant.
2. Applicant must have correctly logged the additional training.
3. Applicant must submit a new IACRA Application seeking the appropriate Certificate or Rating.
4. Authorized Recommending CFI signed Endorsement is required from the CFI who conducted the additional training in Applicant’s logbook. § 61.195(h): Explicitly states that any flight instructor who provides training or makes an endorsement for an Initial Flight Instructor Certificate Applicant must meet the specific experience/qualification criteria (holding a CFI certificate for at least 24 calendar months and/or meet the alternative recent pass-rate criteria).
5. If 60 days has lapsed since the time of testing, then the Applicant will be unable to Retest. They must then get a new set of endorsements from a Recommending CFI because the test will be considered a full Practical Test. No credit will be allowed from the previous testing attempt.
Regulation: § 61.49 Retesting after failure.
(a) An applicant for a knowledge or practical test who fails that test may reapply for the test only after the applicant has received:
(1) The necessary training from an authorized instructor who has determined that the applicant is proficient to pass the test; and
(2) An endorsement from an authorized instructor who gave the applicant the additional training.
(b) An applicant for a flight instructor certificate with an airplane category rating or, for a flight instructor certificate with a glider category rating, who has failed the practical test due to deficiencies in instructional proficiency on stall awareness, spin entry, spins, or spin recovery must:
(2) Bring an aircraft to the retest that is of the appropriate aircraft category for the rating sought and is certificated for spins; and
(3) Demonstrate satisfactory instructional proficiency on stall awareness, spin entry, spins, and spin recovery to an examiner during the retest.
